Dabba Cartel Pty Ltd – Subscription Service Terms and Conditions

Welcome to Dabba Cartel Pty Ltd These Terms and Conditions (“Terms”) govern your subscription and use of our food delivery service. By subscribing to and using our service, you agree to be bound by these Terms. Please read them carefully.

  1. Definitions
  • “We,” “Us,” “Our”: Refers to Dabba Cartel Pty Ltd, ABN 14680173871
  • “You,” “Customer,” “Subscriber”: Refers to the person, organization, or entity subscribing to and using our service.
  • “Service”: Refers to our food delivery subscription service.
  • “Products”: Refers to the food and beverages we deliver as part of the Service.
  • “Website”: Refers to www.dabbacartel.com.au

2. Acceptance of Terms

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.1 If you do not agree with any part of these Terms, you must not2 use our Service.

3. Subscription

  • Subscription Options: We offer various subscription plans such as Daily Dabbas, Meal Prep and Bespoke Catering, details of each plan, including pricing and included items, are available on our Website.
  • Eligibility: You must be at least 18 years old to subscribe to our Service.
  • Account Creation: You will need to create an account to subscribe. You are responsible for maintaining the confidentiality of your account information.
  • Subscription Period: Your subscription will continue for the period you select [e.g., daily, weekly, monthly] 

4. Orders and Delivery

  • Order Schedule: You can choose your preferred delivery days, subject to availability. A minimum 12-24hrs notice is required when placing an order.
  • Delivery Area: Our Daily Dabba’s are delivered to Melbourne CBD and surrounding suburbs (8kms radius from Port Melbourne). Weekly Meal Prep Mealsare delivered to 455 suburbs all throughout Melbourne and can be found on the Cookaborough Website. 
  • Delivery Times: Our Daily Dabba’s are delivered between 12pm-1:30pm, we will endeavour to deliver within the agreed upon timeframes. However, delivery times are estimates only and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control.
  • Delivery Instructions: You must provide accurate delivery instructions. We are not responsible for deliveries to incorrect addresses if you provide incorrect information.
  • Missed Deliveries: If you are not available to receive a delivery, you can choose to reschedule your delivery or we can leave your dabba in a nominated safe space. 
  • Risk of Loss/Damage: Loss or damage of our Dabba’s incurs a fee of $10. 
  • Return/Swapping of Dabba’s: If you have placed an order with us for multiple days, we will swap the Dabba’s on the next drop off. If you’d like to return a Dabba, it is your responsibility to schedule a time with us for pick up. You must ensure the Dabba’s are returned to us rinsed with no food remnants of the previous meal. All our Dabba’s our dishwasher friendly. 

5. Food Safety and Quality

  • Our Commitment: We adhere strictly to the Australia New Zealand Food Standards Code and all relevant state/territory food safety regulations.
  • Handling and Storage: You are responsible for the safe handling and storage of Products after delivery.
  • Allergen Information: We provide allergen information, but you must inform us of any allergies before ordering.
  • Perishable Goods: Our Products are perishable and should be consumed promptly.

6. Payment and Billing

  • Pricing: Subscription prices are as stated on our Website and are subject to change.
  • Payment Methods: We accept Credit/Debit Card, Apple Pay. 
  • Price Changes: We will notify you of any price changes in advance.
  • Taxes: Prices include GST where applicable.

7. Cancellation and Refunds

  • No Cancellations: You can reschedule to receive your meal on another day, the meal may vary depending on the menu for that day.
  • Australian Consumer Law: Your rights under the Australian Consumer Law apply.

8. Limitation of Liability

  • We are liable for breaches of consumer guarantees under the Australian Consumer Law.
  • Our liability is otherwise limited to the extent permitted by law.

9. Intellectual Property

All content related to our service is our intellectual property.

10. Privacy Policy

We handle your personal information according to the Privacy Act 1988 (Cth).

11. Governing Law

These Terms are governed by the laws of Victoria, Australia.

12. Changes to Terms

We may change these Terms at any time.
